- هناك امر ثان هو ان الالتزام نص على حماية الشواطئ والبحار والممرات المائية والبحيرات ولم ينص صراحة وبوضوح على حماية المياه الاقليمية الواقعة بين الحدود البحرية الدولية المعترف بها وبين المياه الاقليمية الخاضعة لسيطرة الدولة و واجب حمايتها من تهديد يمس باعمال السيادة للدولة عليها كعدم السماح لتواجد اساطيل عسكرية لاى قوة دولية داخل الحدود الاقليمية البحرية وعدم السماح بممارسة اعمال الحفر والتنقيب عن الثروات الطبيعية الواقعة داخل الحدود الاقليمية البحرية للدولة وعدم السماح بالقاء المخلفات الصناعية والملوثات والنفايات  الاشعاعية والبايولوجية  داخل الحدود الاقليمية البحرية

ملاحظات على مواد الدستور المقترح (4)

مادة (70) : يحظر تشغيل الطفل قبل تجاوزه (سن الالزام التعليمى) فى اعمال لاتناسب عمره او تمنع استمراره فى التعليم .
- المخالفة الصريحة للاعلان العالمى لحقوق الطفل الذى يحظر تشغيله بما يعوق نموه
- المادة حظرت التشغيل فقط فى الاعمال التى لاتناسب السن او تمنع استمراره فى التعليم واتاحت واباحت تشغيله فيما عدا ذلك فاتحة المجال للاتجار بالبشر الذى اصرت على تجاهله تماما فى مادة تالية هى المادة (73)
- لو كانت النية حسنة لنصت المادة على الاتى ( يحظر تشغيله بما يعيق نموه واستمراره فى التعليم فى اعمال تقع ضمن نطاق مفهوم الاتجار بالبشر ) ولكانت بذلك قطعت الطريق على اى التفاف او تحايل على نص المادة

ملاحظات على مواد الدستور المقترح (3)

مادة(64) : ..... ويعمل الموظف العام فى خدمة الشعب وتتيح الدولة الوظائف العامة للمواطنين على أساس (الجدارة والكفاءة دون محاباة او ساطة )
- تجاهلت المادة النص على (التمييز على اساس الجنس والدين ) حيث يقتصر مدلول المحاباة على الطائفة بينما يمتد مدلول التمييز ليشمل الجنس و الدين وبذلك يكون المعيار الذى تركن اليه المادة يخالف المقومات الاساسية للدولة التى تقوم على المساواة بين كافة المواطنين وحقهم فى تولى الوظائف العامة بغض النظر عن الجنس او الدين .

ملاحظات على مواد الدستور المقترح (2)

مادة (64) : لايجوز فرض أى عمل جبرا إلا بمقتضى قانون.
- مخالفة صريحة لاعلان حقوق العمال الذى اقرته كافة الدول الاعضاء بالامم المتحدة والذى ترعاه منظمة العمل الدولية والتى تشارك مصر فيها كدولة عضوا بالامم المتحدة
- لايمكن الاجبار على اى عمل ولو بقانون فى الاحوال الطبيعية
- حالات الاجبار تكون فى ظروف استثنائية فقط ويقصد بها حالات الحرب حيث يعطل العمل بالقانون والدستور وتفرض الاحكام العرفية
